YOU HEREBY ACKNOWLEDGE AND AGREE THAT BY PURCHASING A TRAIN FOR LONGEVITY MEMBERSHIP, YOU HAVE CAREFULLY READ THE FOREGOING RELEASE AND INDEMNIFICATION CLAUSE AND UNDERSTAND THE CONTENTS THEREOF. YOU ACKNOWLEDGE AND ARE MADE FULLY AWARE THAT NEITHER WILD WARRIOR NUTRITION, KEVIN RAIL, NOR OUR STAFF ARE PROVIDING MEDICAL, NUTRITION, OR DIETETIC ADIVCE, AND THAT WILD WARRIOR NUTRITION AND KEVIN RAIL ARE ONLY PROVIDING FITNESS AND GENERAL HEALTH EDUCATION TO YOU. YOU ACKNOWLEDGE BEFORE BEGINNING, IMPLEMENTING, OR USING ANY AND ALL OF PROGRAMS, PROVIDED, THAT YOU SHOULD CONSULT A MEDICAL DOCTOR AND GET PRIOR WRITTEN CONSENT TO PARTICIPATE.
YOU HEREBY ACKNOWLEDGE AND AGREE THAT IT IS THE INTENTION OF THE PARTIES THAT THE FOREGOING RELEASE AND DISCHARGE SHALL BE EFFECTIVE AS A BAR TO ALL CLAIMS OF WHATEVER CHARACTER, NATURE, AND KIND, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, HEREIN ABOVE SPECIFIED TO BE SO BARRED. 5. Limitations
In no event shall Wild Warrior Nutrition or its suppliers be liable for any damages (including, without limitation, consequential, special, incidental, direct, indirect, exemplary, or punitive damages or damages for loss of data or profit, breach of our online privacy policy, breach of these Terms and Conditions of Use, or due to business interruption) arising out of the use or inability to use the materials on Wild Warrior Nutrition’s Internet site, Wild Warrior Nutrition’s use of information you provide, the products sold to you, or any other claim you may have, even if Wild Warrior Nutrition authorized representative has been notified orally or in writing of the possibility of such damage and regardless of the theory of liability giving rise to such claim whether negligence, contractual, tort, strict liability or otherwise.
